Discussion forum conditions of use
The Office of Fair Trading’s discussion forum gives you an opportunity to express your opinion on a range of issues affecting consumers and traders in New South Wales.
Registration
Not all of the Fair Trading discussion forums require registration.
To be able to submit a post to a discussion forum that requires registration, you must:
- sign up for an account by specifying a username and valid e-mail address (a temporary password will be sent to the e-mail address that you specify); and
- sign in to the discussion forum with that username and password.
To submit a post on a discussion forum that does not require registration, you must:
- specify a screen name in the name field. The screen name will be published on the discussion forum with your post; and
- specify a valid e-mail address. The e-mail address will not be published on the discussion forum with your post.
Moderation of Discussion Forum
A post submitted to a discussion forum:
will be reviewed by a forum moderator before it is published on the discussion forum; and
may not be published on the discussion forum until the business day following its submission.
A post submitted to a discussion forum will not be published if, in a forum moderator’s opinion, it:
- contains inappropriate language;
- may contravene any applicable law eg by breaching copyright, defaming a person, committing contempt of court or encouraging illegal activity;
- contains an advertisement or is spam;
- is not related to the discussion topic specified by Fair Trading;
- contains personal information;
- is written, wholly or in part, in a language other than English (Fair Trading does not have the resources to support multi-lingual discussion); or
- is unsuitable for any other reason.
A forum moderator may remove any post published on a discussion forum, without notice, for any of the reasons specified in clause 5.
Fair Trading does not undertake that forum moderators will ensure that only posts complying with these usage conditions will be published on a discussion forum.
Intellectual Property
You irrevocably consent to:
Fair Trading reproducing in any form, publishing, communicating to the public, and adapting, posts you submit to the discussion forums; and
if Fair Trading thinks fit, doing any of those things without identifying you as the author.
Disclaimer
Fair Trading disclaims all responsibility and all liability (including without limitation, liability in negligence) to any person in respect of: anything; and the consequences of anything, done, or not done, by any such person in whole or partial reliance upon the whole or part of the information published on the discussion forums.
Release
You agree to release the Director-General, Fair Trading and its officers from and against all actions, proceedings, suits, claims, demands, compensation, interest, damages, costs, charges and expenses whatsoever in relation to your use of the discussion forums.
Indemnity
You agree to indemnify and keep indemnified the Director-General, Fair Trading and its officers from and against all actions, proceedings, suits, claims, demands, compensation, interest, damages, costs, charges and expenses whatsoever in relation to your use of the discussion forums.
Privacy

Fair Trading may contact you in relation to a post you have submitted to a discussion forum via the e-mail address you specify.
Variation
Fair Trading reserves the right to vary these usage conditions without notice. You agree to be bound by any variation to the usage conditions by continuing to use the discussion forums.
